Copyright Protection
Prime respects intellectual property rights and expects the same from users. We respond to valid copyright infringement notices in accordance with applicable law (including the DMCA for users in the United States).
Service Provider Status
Prime acts as a service provider and does not pre-screen user content. We are not responsible for content posted by users until we receive a proper infringement notice. Acting in good faith upon receipt of a valid notice, we remove or disable access to the disputed material.
Filing an Infringement Notice
A copyright infringement notice must include:
- Electronic or physical signature of a person authorized to act on behalf of the copyright owner
- Identification of the copyrighted work you believe has been infringed
- URL or other specific location of the material you believe infringes rights
- Your contact information (address, phone, email)
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner (under penalty of perjury)
Knowingly false notices may result in legal liability. You may be liable for damages (including costs and attorneys' fees) caused by misrepresentation in the notice.
Review Process
We process valid notices within a reasonable time. Upon confirmation of infringement, we remove or disable access to the material and notify the user. We may forward a copy of the notice and user contact information to the copyright owner. We do not disclose user personal data except as required by law or court order.
Counter Notice
If you believe your content was removed by mistake or as a result of misidentification, you may file a counter notice. Upon receipt of a valid counter notice, we may restore the material if the copyright owner does not file a court action within the statutory period.
A counter notice must include your signature, identification of the removed material, a statement under penalty of perjury that the material was removed by mistake, your contact information, and consent to court jurisdiction.
Repeat Infringers
Under our repeat infringer policy, we terminate service access for users who repeatedly infringe copyrights. The decision to terminate is at our sole discretion.
Limitation of Liability
Prime is not liable for content posted by users. We act as an intermediary and do not verify content legality prior to receiving a notice. Our liability is limited to removing or disabling material upon receipt of a proper notice. We do not guarantee immediate removal and are not liable for any damages arising before removal.
